Delhi minister Atishi says, "BJP arrested Arvind Kejriwal in a false case. First, they arrested him through their political tool - ED. When they understood that he was going to walk out of jail in that case, that he had been granted bail by the trial court and the Supreme Court was going to grant him bail too - they had him arrested by their another political tool, the CBI. So that Arvind Kejriwal could not walk out of jail despite getting bail. What is the BJP trying to do in jail? BJP is trying to permanently damage his health, his body. Arvind Kejriwal has been diabetic for 30 years...A person gets only 20-30 minutes if their sugar levels reach dangerous levels and drop to a level that the patient's body stops working. If sugar doesn't reach the brain, it can lead to brain damage. Arvind Kejriwal's sugar level has touched this dangerous level 5 times...Today, BJP has endangered the life of Delhi CM Arvind Kejriwal...BJP can stoop to such a level that, through Tihar jail administration, they brought some documents before the media stating that there are no issues with the health of Arvind Kejriwal. But BJP should know that they may lie as much as they want, but ultimately truth triumphs. One of the documents released by the BJP is a report by Tihar Jail medical officer. This report clearly shows how Arvind Kejriwal's health is being toyed with...If Arvind Kejriwal's sugar level keeps dropping like this, he can slip into a coma, he can suffer a brain stroke. He can suffer permanent brain damage. This is what Tihar Jail report shows. I would like to tell the BJP - stop playing with the life of Arvind Kejriwal, stop doing politics over his health..."

/Assuming, like Soren, Kejriwal had resigned before the bail was granted, could the Court have stopped him from re-assuming the office of the chief minister and created restrictions on his functioning? If the Jharkhand High Court’s order is any indication, it seems that the Delhi CM might not have faced restrictions had he resigned before being arrested – because there is no such precedent. The restrictions imposed on him appear especially jarring because the Court criticised the ED for behaving in a “biased” manner. The conditions imposed on Kejriwal go against the first principles of criminal law.
A cardinal principle of criminal law is that an accused is presumed to be innocent until proven guilty. Laws such as the PMLA seem to deviate from this principle through provisions which lay a very high bar for the defence – they appear to place the burden of proof on the accused. PMLA pre-supposes a benevolent State and fair prosecutorial practices. Unfortunately, however, these assumptions have been turned on its head. In Kejriwal’s case, the SC held that the ED had only produced and relied upon inculpatory evidence while concealing exculpatory evidence. It should, therefore, not have imposed restrictions on the functioning of a constitutional functionary.

Arvind Kejriwal's interim bail in ED case to impact other accused. See list The top court has set a new precedent as it raises questions about the power, necessity, and policy of arrest under Section 19 of the PMLA by the ED.
Meanwhile, experts believe that today's judgement will significantly impact other ED cases. The ruling questions the manner and timing of arrests, and it mandates that sufficient reasons must be provided to the arrestee, justifying the arrest in accordance with the law.
CASE TO BE IMPACTED
Manish Sisodia: Former Delhi Deputy Chief Minister Manish Sisodia is currently behind bars in the Delhi liquor policy case. His case, which stands on almost equal footing, is likely to be impacted by today's judgement. His bail plea is already subjudiced before the Supreme Court.
K Kavitha: BRS leader K Kavitha, also an accused in the Delhi liquor policy case, is behind bars with her case pending before the court. She faces charges from both the CBI and the ED.
Satyendra Jain: Former Delhi Health Minister Satyendra Jain is in jail in connection with an alleged money laundering case.
Karti P Chidambaram: Congress MP Karti Chidambaram from Sivaganga is accused in the Chinese Visa case of allegedly accepting a Rs 50 lakh bribe to approve the re-use of 263 project visas for Vedanta Group Company's subsidiary, Talwandi Sabo Power Plant Ltd. (TSPI).
NCP Leader Nawab Malik: Malik is involved in an alleged money laundering case with links to the D-company and a purported conspiracy to 'usurp' the Goawala building compound in Kurla West in 1996.
Shiv Sena Leader Sanjay Raut: Raut is accused in the Patra Chawl scam case, involving alleged money laundering from a Rs 1,034-crore land scam related to the redevelopment of the chawl in Mumbai's Goregaon.
Jharkhand Chief Minister Hemant Soren: Hemant Soren, arrested in January for money laundering and illegal land acquisition, is currently out on bail. The Enforcement Directorate has challenged his bail in the Supreme Court.
TMC MP Abhishek Banerjee: Banerjee has been named and summoned by the ED in several cases, including one related to government school recruitment.
Former Chief Minister of Bihar Lalu Prasad Yadav: Yadav is accused of soliciting land in return for jobs on the railways.
A BJP MLA in Madhya Pradesh advised students to open "motorcycle puncture repair shops" since nothing would be gained by obtaining degrees, the statement ironically coming at an event to inaugurate a 'PM College of Excellence' in his Guna assembly constituency.
Union Home Minister Amit Shah had e-inaugurated PM College of Excellence in 55 districts in the state on Sunday at a function held in Indore, with separate events held in the respective districts, including Guna.
Advocate Jai Anant Dehadrai called the Supreme Court's judgement in Arvind Kejriwal's case extremely significant, adding that the top court has referred the underlying appeal challenging the legality of his arrest to a larger bench. The court has narrowed its focus to the aspect of the "necessity of arrest" in cases such as Kejriwal's, where there has been a considerable delay in arresting an accused person. Notably, the court has been critical of the Enforcement Directorate's (ED) approach in drafting reasons to believe, as required under Section 19 of the Prevention of Money Laundering Act (PMLA), based on materials that date back prior to July 2023.
