When an accused is in custody under the Prevention of Money Laundering Act (PMLA), any incriminating statement given to the ED is inadmissible in evidence: Supreme Court.
"We have no hesitation in holding that when an accused is under custody under PMLA, irrespective of the case of which he is under custody, any statement under Section 50 to the same investigating agency is inadmissible against the maker"

In a significant judgment, the Supreme Court on Wednesday (August 28) held that a statement given by an accused, while under custody in a case under the Prevention of Money Laundering Act(PMLA), to investigating officers of the Enforcement Directorate (ED) incriminating oneself in another money laundering case would be inadmissible in evidence.

The Court held that such a statement given by an accused under custody cannot be treated as admissible under Section 50 of the Prevention of Money Laundering Act.

A bench comprising Justices BR Gavai and KV Viswanathan made this significant pronouncement while granting bail to an accused in a money laundering case. The bench noted while the accused was under custody in connection with one Enforcement Case Information Report (ECIR), his statements were recorded by the ED officers in connection with the present ECIR.

The bench considered the following question - when a person is in judicial custody/custody in another case investigated by the same investigating agency, whether the statements recorded for a new case in which arrest is not yet shown and which is claimed to have incriminating materials against the maker would be admissible under S.50 PMLA.

"It would be a travesty of justice to render the statement admissible against the appellant," the Court held. The Court said that the accused cannot be told that while giving the statement, he was wearing the hat of the other case and not the present case.

PREM PRAKASH JHARKHAND PMLA CASE : In a judgment of significant implications, the general principle of law that 'bail is rule and jail is exception' applies even to money laundering cases under the Prevention of Money Laundering Act (PMLA), the Supreme Court held on Wednesday while granting bail to one Prem Prakash, an alleged aide of Jharkhand Chief Minister Hemant Soren in a money laundering case.

"Relying on the judgment in Manish Sisodia, we have said that even in PMLA, bail is a rule and jail the exception. All that Section 45 specifies is the conditions to be met for bail. Liberty of the individual is always the rule and deprivation, by procedure established by law, the exception. Twin test does not take away this principle," the Court said reading out its judgment.

Anil Ambani's Reliance Communications owed Rs 49,000 crore to 53 banks, but NCLT admitted only Rs 47,000 crore and settled for just Rs 455 crore—0.92% of the total debt.

Debt-ridden telecom company Reliance Communications (RCom) told, it owes around Rs 26,000 crore to Indian banks and financial institutions. The Indians banks, various vendors and other creditors have made claims of around Rs 86,000 crore on the company which is currently going through insolvency proceedings.

The creditors have submitted claims of around Rs 49,000 crore on RCom, Rs 24,000 crore on Reliance Telecom and Rs 12,600 crore on Reliance Infratel before the National Company Law Tribunal (NCLT). As per figures certified by the Resolution Professional appointed by the lenders, the RCOM group owed around Rs 26,000 crore to Indian banks and other financial institutions as on the date of filing before the NCLT.

NASA said Thursday it will decide this weekend whether Boeing’s new capsule is safe enough to return two astronauts from the International Space Station, where they’ve been waiting since June.

Astronauts Butch Wilmore and Suni Williams launched aboard Boeing’s Starliner on June 5. The test flight quickly encountered thruster failures and helium leaks so serious that NASA kept the capsule parked at the station as engineers debated what to do.

Now that she’s working from home, Kendra King takes an early afternoon nap on most days, typically for about 20 to 30 minutes.

“A lot of times, I don’t go in with the intention of taking a nap, but instead to lay down and rest,” said King, a writer in Philadelphia. “Then I end up drifting off and wake up feeling energized and fresh to continue on my day.”

The Yogi Adityanath-led UP govt has approved a controversial new digital media policy incentivising positive coverage of its work by social media influencers and digital platforms while threatening legal action against content that it deems “objectionable” or “anti-national.”

The contempt case in the Supreme Court against the Delhi Development Authority (DDA) over tree felling will now be heard by a bench led by the Chief Justice of India instead of the bench led by Justice Abhay S Oka.

The case is listed tomorrow before a bench comprising CJI DY Chandrachud, Justices JB Pardiwala and Manoj Misra.

The matter was heard on several days in June-July by a bench comprising Justices Abhay S Oka and Ujjal Bhuyan, during which the DDA and its Vice Chairman had to face several tough questions from the bench. During the hearings, the bench had observed that the materials indicated the role of Delhi Lieutenant Governor V K Saxena, who happens to be Chairman of the DDA, in ordering the tree felling in Delhi's ridge forest. The bench also minced no words in pulling up the DDA for "cover-ups". At the last hearing on July 12, the bench had warned that it would issue contempt notice to the LG and posted the matter for further hearing on July 31.

Meanwhile, on July 24, another bench led by Justice BR Gavai, took objection to Justice Oka's bench taking up the contempt petition. Justice Gavai observed that his bench had issued notice to the DDA on a contempt petition (filed by another petitioner) with respect to the same tree felling much before Justice Oka's bench initiated the proceedings. The bench led by Justice Gavai, noticing the parallel proceedings, referred the matter to the Chief Justice of India and opined that all matters pertaining to the Delhi ridge forest be dealt with by one single bench.

The felling of trees was done for the road widening project from Main Chhattarpur Road to SAARC Chowk, Gaushala Road Row and from SAARC Chowk to CAPFIMS (Hospital) Row.
