The Supreme Court on Monday (September 2, 2024) granted bail to Delhi Chief Minister Arvind Kejriwal's aide Bibhav Kumar in the Swati Maliwal assault case. A Bench of Justices Surya Kant and Ujjal Bhuyan directed that Mr. Kumar will not be reinstated as a personal assistant to Kejriwal or given any official assignment in the Chief Minister's Office.

A Bench of Justices Hrishikesh Roy and SVN Bhatti said that the Enforcement Directorate (ED) has not been able to complete trial on time despite its assurances to the Court, and around 350 witnesses have to be examined.The Court further noted that Nair has been in custody for 23 months and that trial against him cannot become a punishment.

Bail is rule and jail is the exception, the Court underscored.

"In the case at hand, the petitioner is in custody for 23 months and his incarceration as undertrial cannot be a mode of punishment without trial being commenced. The universal rule of bail being rule and jail being exception will be defeated if the petitioner is kept incarcerated without trial being started," the Court stated.

The right of liberty under Article 21 is a sacrosanct right which requires to be respected even in cases where stringent provisions are enacted under special laws like the Prevention of Money Laundering Act (PMLA), the Court said.The Court also took into account the bail orders passed by it in the case of Manish Sisodia and K Kavitha, the other accused in the case.

"We have perused the reasoning the judgment granting bail to Manish Sisodia. In the said proceedings, the court had reiterated right of an accused to speedy trial under Article 21 and also the fact that the fundamental rights guaranteed under Article 21 cannot be subjugated to statutory power under PMLA," the bench said.

Hence, it ordered that Nair be released on bail subject to the same conditions given in Manish Sisodia and K Kavitha bail orders.

The Supreme Court on Monday (September 2) expressed the intention to lay down pan-India guidelines to address the concerns that authorities in several States are resorting to the demolition of houses of persons accused of crimes as a punitive action.

Before the bail was granted however, a counsel entered appearance for Maliwal and raised a grievance that she was facing victim-shaming and trolling over social media ever since the incident.

"In this case, the crime has not ended on 13th May itself. After that, the kind of trolling and victim shaming I am going through...I have to lodge a complaint. The petitioner's friends are continuously trolling...on X, on mails, on social media, everywhere..." he said.

The contention was countered by Senior Advocate Dr AM Singhvi, saying that Bibhav does not control 'X' (formerly, Twitter). The bench however sympathized with Maliwal's grievance.

"Trolling in social media is really atrocious. Everybody is affected...[even] Judges are trolled...we pass an order in favor of someone, the other side would troll the judge", remarked Justice Bhuyan.

At this point, Singhvi urged that even judges and lawyers are subjected to trolling when they deal with unpopular causes.

Suggesting that such remarks should be ignored, Justice Kant said, "Huge class of irresponsible people, unfortunately they have got an access to this platform. They are completely insensitive, irresponsible...they are not aware of their duties. They only think of some perceived rights and they will continue to attack all institutions. Except that, one has to ignore them. The more you [...], their credibility...".
