    1. One of the last bills to be passed by #Parliament before the 2014 Lok Sabha elections was the #Whistleblower Protection Act, notified by Govt in May 2014. - The Act was in response to killings of some #RTI activists and #whistleblowers who had exposed corruption in public dealings. Law Commission had also presented a report on it and the Supreme Court had also issued directives to the Govt to act in this regard. - The Act provided for a mechanism for making 'public interest disclosures', inquiry into such disclosures, protection of whistleblowers, witnesses against victimisation, protection of their identity, offences and penalties etc. - There was scope for further improvement in the Act, but it filled an important vacuum. - See the notified Act here - https://sansad.in/getFile/BillsPDFFiles/Notification/2010-97-gaz.pdf?source=loksabhadocs… Then the Govt changed. 2. The notified Act said that it will come into force on a date appointed by the Govt. It's been 10 years and the Govt hasn't appointed a date for the Act to come into force yet, in effect, reducing it to a mere piece of paper. But WHY did the Govt not operationalise it despite its tall claims of fighting #corruption?
    3. As can be seen from the response to this #Parliament Question answered in Feb 2023 i.e. 9 years after the Act was passed by Parliament, the Govt itself admits that it hasn't enforced the Act yet. Reason - safeguards needed against disclosures affecting sovereignty, integrity, security of state etc. - Within a year of forming Govt, a Bill to amend the #whistleblower protection Act was brought in May 2015. - This Bill provided for a long list of exemptions, in effect, prohibiting making disclosures related to a wide range of categories. The Govt managed to push Bill through #LokSabha despite many MPs opposing it, arguing that by creating exception for national security etc., corruption in defence procurement deals will be kept hidden. Many MPs suggested that the Bill should be sent to a Standing Committee. In fact, as per debate records, one MP said - "During the past 12 months, 44 Bills out of 51 Bills, have been passed by this House without any consultation, without taking any evidence, and without any discussion in the Standing Committees". So, no wonder that this Bill also wasn't sent to the Standing Committee. 5. Though the Govt managed to get Bill passed in Lok Sabha, it got stuck in #RajyaSabha, where Govt didn't have majority that time. Also, the opposition was pressuring the Govt to send it to a Select Committee.

    6. It simply let the Bill lapse. It realised that it doesn't need to amend the Bill at all, because it can avoid operationalising it altogether simply by not appointing a date for its enforcement and not framing the rules for the same. 7. The Act seems to have fallen off the radar of MPs as well since only 6 #Parliament Questions have been asked on the Act since 2019.

In absence of the protection extended to whistleblowers by the Act, as per a response given in #Parliament (unstarred Q No. 2827, dated 12.12.2019) currently two resolutions are in place which designate Central Vigilance Commission as the main agency and Central Vigilance Officer in each department/ministry to receive complaints. But, it leaves the whistleblowers vulnerable as CVC “may issue directions” for their protection and they can be victimised as CVC has only issued “guidelines” asking organisations not to harass the complainants if their identity is revealed (see pic).

81. Months after peace pact with United National Liberation Front, Manipur sees rise in extortion cases.
    Three months after MHA and the Manipur government signed a peace agreement with one of the factions of UNLF, the oldest valley-based armed insurgent group, officials said the terms of the pact — which include monitoring of the armed cadres — are not available to the central security agencies.
    Neither has a camp been designated for holding the armed cadres nor has the Central Armed Police Force (CAPF) or the State Police been nominated to monitor the movement of the cadres, a second government official said. The total number of cadres and the monthly stipend to be allocated to the cadres is also not known.
    In 2008, after the Manipur government, the Ministry of Home Affairs (MHA) and 24 Kuki insurgent groups formalised a Suspension of Operation (SoO) pact, the Assam Rifles was designated as the monitoring agency. The pact, extended annually, is set to expire on February 28.
    After the ethnic violence erupted in the State between the tribal Kuki-Zo people and the Meitei community on May 3, 2023, Manipur Chief Minister N. Biren Singh claimed that SoO groups had violated ground rules and instigated the violence. Meitei civil society groups have demanded that the pact not be extended by the MHA.
    The UNLF, formed in 1964, is one of the eight “Meitei extremist organisations” that were declared unlawful by the MHA under the anti-terror Unlawful Activities (Prevention) Act, 1967.
    “The military wing of the UNLF has been roaming around in vehicles brandishing weapons. Their involvement in looting of a police armoury has also been found. Post the signing of the peace pact, the cadres were observed indulging in violence against security forces,” the official said.
