The Supreme Court of India dismissed a Special Leave Petition (SLP) filed by Aam Aadmi Party (AAP) MLA Chaitar Vasava on May 19, 2026, upholding a lower court's decision to reject his plea to recall and re-examine prosecution witnesses. Following this legal development, the Narmada Additional Sessions Court delivered its final trial judgment on June 23, 2026.
Details of the Trial and Conviction
The Verdict: The Narmada Sessions Court convicted Chaitar Vasava, his wife Shakuntala Vasava, and seven others, sentencing them to seven years of rigorous imprisonment along with a fine of ₹25,000 each.
The Case History: The charges stem from an October 30, 2023 incident where forest department personnel were summoned to Vasava's residence in Dediapada. The officials were allegedly verbally abused, physically assaulted, and threatened with a firearm following a dispute over the clearing of illegal crop cultivation on forest land. The accused were also found guilty of extorting ₹60,000 from the officials.
Charges Applied: The trial court held the accused guilty under relevant sections for rioting, extortion, criminal intimidation, assault on public servants discharging official duty, and violations under the Arms Act.
Chronology of Supreme Court and High Court Interventions
Before the final trial court conviction, Chaitar Vasava moved higher judiciaries to contest procedural trial rules:
The Witness Recall Plea: Facing final arguments, Vasava’s legal team requested a recall of specific prosecution witnesses. This was initially dismissed by the sessions court, and subsequently rejected by the Gujarat High Court on May 7, 2026.
Supreme Court Rejection: Vasava appealed this witness recall decision via an SLP to the Supreme Court, which turned down the petition on May 19, 2026, clearing the path for final trial arguments.
Subsequent High Court Ruling: On May 27, 2026, the Gujarat High Court also flatly rejected a separate last-minute request from Vasava to examine new defense witnesses, labeling the application a delay tactic.
Immediate Impact
Following the 7-year prison sentence, the Gujarat Legislative Assembly Secretariat stated that Chaitar Vasava stands immediately disqualified as an MLA under the Representation of the People Act, which mandates the vacating of office for any lawmaker sentenced to two or more years of imprisonment. He will also be barred from contesting elections for six years unless a higher appellate court stays his conviction. AAP leadership has stated they will formally challenge the sessions court’s final conviction in a higher court.

'Rs 100 Per Grave': How Mathura Authorities Calculated Compensation After Damaging Muslim Graveyard.
Among those affected were families who allege that the graves of their fathers, grandfathers and relatives were disturbed after JCBs working under the supervision of local authorities entered the cemetery late at night – a calculated strategy, according to locals.
Nine graves were desecrated at the Ahl-e-Muslimeen Kabristan, which has existed at the site since 1909. Six trees, 20 boundary fencing pillars, greenery and landscaping area were also damaged by the JCBs, which arrived in the middle of the night on the orders of Mathura Nagar Nigam’s Assistant Municipal Commissioners.
But local Muslims view this as a tool to tighten the larger atmosphere in the state.
