One of the most important constitutional cases of our time has been withdrawn from the Supreme Court. The new BJP government in Delhi has decided to withdraw the challenge to the constitutional validity of the Delhi Services Act, 2023 (as expected). History will remember this case as one of the most blatant instances of judicial evasion, where the Supreme Court allowed the matter to languish or remain undecided for an extraordinarily long period—since 2015. Then Chief Justice of India, DY Chandrachud, who authored the Constitution Bench judgment in May 2023, carefully crafted three paragraphs that effectively enabled the Centre to waltz in and overturn what the Court had held. When the new law—granting the Centre full control over transfers and postings of officers—was subsequently challenged, Chandrachud once again allowed the matter to drag on, awaiting the arrival of the Assembly elections. Of course, the listing of cases lies entirely within the Chief Justice’s prerogative and is therefore legal. Yet, the political considerations embedded in the case warrant serious condemnation. This was not merely a BJP vs AAP battle in Delhi—the Supreme Court was an active player too. Which side it was on, is anyone’s guess.
