Satyendar Jain - Prisoner of Bad politics

Allegation : During the period 2015-16 the companies, where Satyendar Jain is a share holder, received accommodation entries to the tune of ₹4.81 crore from shell (paper) companies against cash transferred to Kolkata-based entry operators through the hawala route.

Brief Timeline :
-- Aug 2017: FIR filed by CBI & subsequent Bail later

-- 30 May 2022: Arrested by ED

-- 15 May 2023: SJ moved SC for bail

-- 26 May 2023: Medical Bail due to Major Spinal Injury during his jail term

-- 01 Sept 2023: SC judge PK Mishra recused himself from case

-- 14 Dec 2023: SC judge AS Bopanna got changed

-- 17 Jan 2024: Bail verdict reserved

Allegation 1 -

CBI has accused that Sanjay and Suresh used to work for Satyendra Jain since 2010 and handled his hawala transactions by means of calls to Kolkata using a landline number 011-27314231. It has been accused that the calls were made during 2010 to 2016

Truth:

-- The phone number mentioned above never had STD facility.
-- Moreover the phone has been disconnected since the year 2014.
-- All the call details have been procured for this number. No calls were made to Kolkata from 2010 to 2014.
-- People named Sanjay and Suresh have never worked with the Minister.

Allegation 2 -

CBI has accused that 4 people have come forward and spoken against Satyendra Jain.

Truth:

The truth is that all 4 confessions are false and made under pressure from the central agency.
—Satyendra Jain demanded that all 4 witnesses to be brought in front of him
—When the Income Tax department got one of those persons named Babloo Pathak to face Satyendra Jain, it didn’t take him even 5 minutes to admit that the minister had no role in the alleged transactions
—Then the minister requested to get the other 3 witnesses too to which the Income tax department gave in writing that this will not be done
—This proves that the CBI and the Income Tax department are being used as tools by the Central government to malign the AAP government

Case Timeline -

Sep 27 2016 - The Income Tax department has issued summons to Jain in connection with its tax evasion probe against certain Kolkata-based firms. [1]

Jan 6 2017 - Jain gets another I-T notice in hawala case

August 2017 - FIR filed by the CBI against him and others on charges of alleged possession of disproportionate assets (DA)

August 2017 - The PMLA case was registered by the ED on the basis of CBI FIR

April 2018 - ED questioned Delhi Minister Satyendar Jain

December 2018 - Charge sheet filed by CBI stating that the alleged DA was to the tune of ₹1.47 crore, about 217 per cent more than his known sources of income, during 2015-17

September 6, 2019 - Regular bail granted in the CBI case

Mar 22, 2022: Satyendar Jain made Himachal Pradesh in-charge of AAP for Assembly elections later that year

ED and PMLA - Arrested for 1.5 Years, No bail yet
April 2022 - ED Attached land / Immovable assets - land in Delhi worth ₹4.81 crore belonging to companies linked to the case — Akinchan Developers, Indo Metal Impex, Paryas Infosolutions, Mangalyatan Projects, and JJ Ideal Estate — and Jain’s relatives Swati Jain, Sushila Jain, and Indu Jain

May 30 2022 - Enforcement Directorate(ED) arrested Jain, in an alleged money laundering case under stringent PMLA

May 31 2022 - Arvind Kejriwal defend Satyendar Jain, while addressing a press conference "I have personally read all the papers and the case filed against Satyendra Jain by ED and it is completely false. We have a very strict and honest government. We are hard-core patriots; we can get beheaded but can never betray the country. His arrest is politically motivated,"

Part 3a: Search at SJ residence & misleading claims by ED

June 6 2022 - ED conducted searches at the residence of Delhi Minister Satyendar Jain & other accused in the case

June 6 2022 - Misleading claim by ED of cash Rs. 2.85 crore and 133 gold coins weighing 1.80 kg “at the premises of Satyendar Kumar Jain and others” i.e. under collective seizure (No individual accused details). The agency did not give a breakup of what was seized from which location

June 7 2022 - The seizure memo of the ED raid given to the wife and daughter of Satyendar Jain clarified NO seizure from Satyendar Jain

June 7 2022 - "In the memo, it was mentioned that various documents, one digital device, and Rs 2,79,200 was recovered during the search. However, the same was not seized,”.

July 30 2022 - Delhi court pulls ED up for ‘wrongly’ linking Satyendar Jain
Court said: "He was neither the director nor associated with them."

September 09 2022 - Court to ED - "Where is criminal activity?"
Court rebuked ED - "Why the Enforcement Directorate went beyond the Central Bureau of Investigation’s case to look into alleged proceeds of crime that are not mentioned in the chargesheet."

September 19 2022 - ED seeks transfer of trial (when the bail hearing of all the accused was at the final stage) and Delhi court stays proceedings against Satyendar Jain

September 23 2022 - Delhi court allows ED plea seeking transfer case to new judge

Oct 01 2022 - Delhi High Court dismisses Satyendra Jain's plea against transfer of his bail plea

14 October 2022: Himachal Pradesh election announced by the Election Commission of India. Satyendar Jain was State incharge of Himachal Pradesh when he was arrested.
